Prior to July 1, 2009 anyone under a guardianship or a conservatorship was referred to as a "ward". Now a person under a guardianship is an "incapacitated person" and someone under a conservatorship is a "protected person". If individuals failed to properly plan in the event of their
disability, and they become incapacitated, the only viable solution
may be a guardianship or
conservatorship.
A guardian is a person appointed by the probate court to make
personal and financial decisions for the incapacitaded person (I.P.), either due to
age (minors), incapacity or mental illness. A guardian has custody
of the person of the I.P. and can make all decisions concerning
the I.P’s well-being, including medical treatment and
admittance to a long-term-care facility. |
